Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the LAIT911 mobile applications available through the Apple App Store and Google Play Store, as well as the web-based application accessible at https://app.lait911.org (collectively, the “App”).

The App is operated by Southern California Wildfire Response, doing business as LAIT911 (“LAIT911,” “we,” “us,” or “our”).

By downloading, accessing, creating an account for, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

1. The LAIT911 App

The LAIT911 App provides situational awareness tools, incident information, alerts, historical data, and related features intended to support public awareness of incidents and hazards.

Information displayed in the App may be derived from:

  • Public or third-party data sources
  • Automated systems
  • User-submitted reports
  • Internal aggregation or analysis tools

The App is provided for informational purposes only.

2. No Emergency Use or Reliance

The LAIT911 App is not an emergency service.

  • The App does not provide emergency dispatch.
  • The App does not replace 911 or official emergency notification systems.
  • LAIT911 does not guarantee the accuracy, completeness, timeliness, or availability of any information shown in the App.

You acknowledge and agree that:

  • Alerts may be delayed, incomplete, inaccurate, duplicated, or not delivered.
  • Incident information may be incorrect, unverified, outdated, or misclassified.
  • You will not rely on the App as the sole or primary basis for decisions involving personal safety, evacuation, emergency response, or disaster mitigation.
  • You are responsible for verifying information and following instructions from official authorities.

3. Eligibility and Accounts

You must be at least 13 years old to use the App.

You are responsible for:

  • All activity conducted through your account
  • Maintaining the confidentiality of your login credentials
  • Ensuring information associated with your account is accurate

You may not allow others to access your account or impersonate another person or entity.

4. Subscriptions, Free Trials, and Billing

Subscription Types

The App offers paid subscriptions with the following options:

  • Monthly subscriptions via the Apple App Store and Google Play Store
  • Monthly or annual subscriptions purchased online

Free Trials

Subscriptions may include a 7-day free trial.

Unless canceled before the trial period ends, the subscription will automatically convert to a paid subscription.

Auto-Renewal

All subscriptions automatically renew unless canceled prior to the renewal date.

Billing and Payments

Payments are processed through:

  • Apple App Store (iOS)
  • Google Play Store (Android)
  • Online payment processing for web subscriptions

Billing, cancellation, and subscription management are handled through the platform where the subscription was purchased.

Refunds

All fees are non-refundable, except where required by applicable law.

LAIT911 does not offer discretionary refunds for:

  • Partial subscription periods
  • Missed alerts
  • Perceived inaccuracies
  • Feature changes
  • Account termination

5. User-Submitted Content

The App may allow users to submit content, including reports, comments, images, or other information (“User Content”). User Content may be visible to the public.

You retain ownership of your User Content. By submitting User Content through the App, you grant LAIT911 a non-exclusive, royalty-free, worldwide license to use, reproduce, display, modify, distribute, and create derivative works from that content for the purpose of operating, maintaining, moderating, and improving the App.

You represent and warrant that:

  • You have the right to submit the content
  • The content is accurate to the best of your knowledge
  • The content does not violate any laws or rights of others

6. Content Moderation and Removal

User Content is moderated using a combination of automated systems and human review.

LAIT911 reserves the right, but not the obligation, to:

  • Remove, restrict, edit, or disable access to any User Content
  • Do so with or without notice
  • Take immediate action when content poses safety, legal, or operational concerns

Content may be removed for reasons including, but not limited to:

  • False or misleading information
  • Impersonation of emergency personnel or officials
  • Content that may cause public confusion, panic, or harm
  • Abuse, harassment, or misuse of the App

7. Acceptable Use

You agree not to:

  • Use the App for unlawful purposes
  • Submit false, misleading, or intentionally deceptive information
  • Impersonate emergency responders, government officials, or LAIT911 staff
  • Interfere with or disrupt the App or its systems
  • Attempt to scrape, reverse engineer, exploit, or misuse App data
  • Use the App in a manner that could reasonably endanger others or interfere with emergency operations

Violation of these Terms may result in suspension or termination of your account.

8. Intellectual Property

All content, features, software, designs, text, graphics, logos, and trademarks within the App are owned by or licensed to LAIT911 and are protected by applicable intellectual property laws.

You are granted a limited, revocable, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

No ownership rights are transferred to you.

9. Availability and Changes

LAIT911 does not guarantee uninterrupted or error-free operation of the App.

We may modify, suspend, or discontinue any part of the App at any time, including features, data sources, pricing, or availability, without liability to you.

10. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, LAIT911 disclaims all warranties, express or implied, including warranties of accuracy, reliability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, LAIT911 shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of or inability to use the App.

This includes, without limitation, damages related to:

  • Personal injury or property damage
  • Missed, delayed, or inaccurate alerts
  • Decisions made based on App content
  • Loss of data, revenue, or opportunity

Some jurisdictions do not allow certain limitations of liability, so these limitations may not apply to you in full.

12. Suspension and Termination

LAIT911 may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms or conduct that poses risk to users, the public, or LAIT911.

Upon termination, your right to use the App immediately ceases.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

You agree to submit to the exclusive jurisdiction of the state and federal courts located in California.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will become effective when posted within the App or on the App’s website.

Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
