Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LAIT911 mobile applications available through the Apple App Store and Google Play Store, the web application at https://app.lait911.org, and related services (collectively, the "App").

The App is operated by Southern California Wildfire Response, a California nonprofit corporation doing business as LAIT911 ("SCWR," "LAIT911," "we," "us," or "our").

By downloading, accessing, creating an account for, or using the App, or by submitting any content through it, you agree to these Terms and to our Privacy Policy at help.lait911.com. If you do not agree, do not use the App.

1. The LAIT911 App

The App provides situational awareness tools, incident information, alerts, historical data, user-submitted reports and images, and related features intended to support public awareness of incidents and hazards.

Information in the App may come from public or third-party data sources, automated systems, user submissions, and internal aggregation or analysis tools. The App is provided for informational purposes only.

2. No Emergency Use or Reliance

The App is not an emergency service. In an emergency, call 911.

  • The App does not provide emergency dispatch and does not replace 911 or official emergency notification systems.
  • LAIT911 does not guarantee the accuracy, completeness, timeliness, or availability of any information in the App.

You acknowledge and agree that:

  • Alerts may be delayed, incomplete, inaccurate, duplicated, or not delivered.
  • Incident information may be incorrect, unverified, outdated, or misclassified.
  • You will not rely on the App as the sole or primary basis for decisions involving personal safety, evacuation, emergency response, or disaster mitigation.
  • You are responsible for verifying information and following instructions from official authorities.

3. Eligibility and Accounts

You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the involvement of a parent or legal guardian who has reviewed and agreed to these Terms.

You are responsible for all activity under your account, for keeping your login credentials confidential, and for keeping your account information accurate. You may not share your account or impersonate any person or entity.

4. Subscriptions, Free Trials, and Billing

Subscription options. The App offers paid subscriptions, including monthly subscriptions through the Apple App Store and Google Play Store, and monthly or annual subscriptions purchased online. Current pricing, billing frequency, and included features are shown to you before you subscribe.

Free trials. A subscription may begin with a free trial (currently 7 days). Before your trial starts, we will clearly show you the price that will be charged, when the first charge will occur, and how to cancel. Unless you cancel before the trial ends, your trial will automatically convert to a paid subscription and you will be charged.

Automatic renewal. All subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. By subscribing, you expressly consent to these automatic renewal terms. We keep a record of that consent as required by law.

Price changes. We will notify you in advance of any price increase, and you may cancel before the new price applies.

How to cancel. You may cancel at any time, and cancellation takes effect at the end of your current billing period.

  • Apple App Store: cancel in your Apple ID subscription settings.
  • Google Play Store: cancel in your Google Play subscription settings.
  • Web subscriptions: cancel online in your account settings at https://app.lait911.org/billing, or by emailing ops@scwr.org.

Billing and cancellation for app-store purchases are handled by Apple or Google under their terms.

Refunds. Fees are non-refundable except where required by law or by the policies of the platform you purchased through. We do not offer discretionary refunds for partial periods, missed or delayed alerts, perceived inaccuracies, feature changes, or account termination.

5. User-Submitted Content and Images

The App may allow you to submit reports, comments, photographs, videos, and other material ("User Content"). User Content may be visible to the public.

5.1 You keep ownership. You retain ownership of your User Content, including any copyright in images you upload. Nothing in these Terms transfers ownership to LAIT911.

5.2 License you grant to us. By submitting User Content, including any image, you grant SCWR and LAIT911 a perpetual, irrevocable, non-exclusive, worldwide, royalty-free, fully paid-up license to use, reproduce, display, publish, distribute, edit, crop, adapt, translate, create derivative works from, and otherwise use that User Content, in any media or format now known or later developed, for any purpose consistent with these Terms. This includes, without limitation:

  • operating, moderating, and improving the App;
  • public safety information, alerts, and incident reporting;
  • websites, social media, newsletters, reports, presentations, and training;
  • fundraising, grant applications, and donor materials; and
  • advertising, marketing, and promotion of SCWR, LAIT911, and their programs and services.

5.3 We will not sell your images. We will not sell your User Content, or charge any third party a fee for a license to use your User Content by itself. The following are not a sale of your User Content:

  • displaying it within the App, including to users with paid subscriptions;
  • including it in incident data feeds provided to our data licensees, including feeds provided for a fee, as described in Section 5.5; and
  • using it in advertising, marketing, or fundraising materials, even when those materials support revenue or donations.

5.4 Sharing with others. We may share and sublicense your User Content, at no charge, to news media, public agencies, fire and emergency response organizations, and community partners for news reporting, public information, public safety, education, or coverage of SCWR's work.

5.5 Data feed licensees. Licensees who receive LAIT911 data feeds may access and display images only as part of the licensed service under their agreement with us. Licensees receive no right to redistribute, sublicense, sell, or separately republish your images.

5.6 Your rights stay yours. Our license is non-exclusive. You remain free to post, share, sell, and license your own User Content to anyone, for any purpose, including commercially.

5.7 No attribution required. We are not required to credit you or identify you as the source of any User Content. When we do give credit, it is a courtesy, and giving credit once does not create an obligation to give it again. We may remove or change usernames, captions, watermarks, or other identifying information when we use User Content.

5.8 No compensation. You will not receive payment, royalties, or other compensation for any use of your User Content.

5.9 Deletion does not end the license. Because the license is irrevocable, it continues after you delete User Content or close your account. User Content may remain visible in the App and in materials where we have already used it, and we are not obligated to remove it. This does not limit our right to remove content under Section 6.

5.10 Moral rights. To the extent permitted by law, you waive, and agree not to assert, any moral rights or similar rights of attribution or integrity in your User Content against SCWR, LAIT911, or those we share it with under these Terms.

5.11 Your promises about what you upload. By submitting User Content, you represent and warrant that:

  • you took the image or created the content yourself, or you otherwise have all rights needed to grant the license in this Section 5;
  • your User Content and our use of it as permitted by these Terms will not infringe or violate any copyright, trademark, privacy, publicity, or other right of any person;
  • any identifiable people in your images were photographed in a public place, or have given you permission; and
  • your User Content is accurate to the best of your knowledge and does not violate any law.

5.12 Location data. LAIT911 does not collect or store location data embedded in images you upload. Any location you choose to type into or attach to a report may be displayed publicly.

6. Content Moderation and Removal

User Content is moderated using a combination of automated systems and human review. We may, but are not obligated to, remove, restrict, edit, or disable access to any User Content, with or without notice, and may act immediately when content raises safety, legal, or operational concerns.

Content may be removed for reasons including false or misleading information; impersonation of emergency personnel or officials; content that may cause public confusion, panic, or harm; graphic images of deceased or seriously injured people; content that interferes with emergency operations; suspected infringement; and abuse, harassment, or misuse of the App.

7. Acceptable Use

You agree not to:

  • use the App for unlawful purposes;
  • submit false, misleading, or intentionally deceptive information;
  • upload content you do not have the right to share;
  • impersonate emergency responders, government officials, or LAIT911 personnel;
  • enter restricted areas, interfere with responders, or put yourself or others at risk to capture images or report incidents;
  • interfere with or disrupt the App or its systems;
  • scrape, crawl, reverse engineer, or systematically download App data or content, or resell, redistribute, or commercially exploit App data without a written data license from LAIT911; or
  • use the App in any way that could reasonably endanger others or interfere with emergency operations.

Violations may result in removal of content and suspension or termination of your account.

We respect intellectual property rights. If you believe content in the App infringes your copyright, send a notice to our designated agent:

Your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and where it appears in the App; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice to the same address as permitted by 17 U.S.C. ยง 512(g). We will terminate the accounts of repeat infringers in appropriate circumstances.

9. Intellectual Property

All content, features, software, data compilations, designs, text, graphics, logos, and trademarks in the App, other than User Content, are owned by or licensed to SCWR and LAIT911 and are protected by intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes under these Terms. No ownership rights are transferred to you. Commercial use of LAIT911 data requires a separate written agreement.

10. Third-Party Services and Data

The App may include data, links, or services from third parties, including government agencies and mapping providers. We do not control and are not responsible for third-party content, availability, or practices.

11. Availability and Changes

We do not guarantee uninterrupted or error-free operation of the App. We may modify, suspend, or discontinue any part of the App at any time, including features, data sources, pricing, or availability. If we change subscription pricing, we will notify you as described in Section 4.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, SCWR AND LAIT911 DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SCWR, LAIT911, AND THEIR DIRECTORS, OFFICERS, MEMBERS, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING DAMAGES RELATED TO PERSONAL INJURY OR PROPERTY DAMAGE; MISSED, DELAYED, OR INACCURATE ALERTS; DECISIONS MADE BASED ON APP CONTENT; OR LOSS OF DATA, REVENUE, OR OPPORTUNITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless SCWR, LAIT911, and their directors, officers, members, and volunteers from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the App, or your violation of these Terms or of any third party's rights.

15. Suspension and Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms or conduct that poses risk to users, the public, responders, or LAIT911. You may stop using the App and delete your account at any time.

Upon termination, your right to use the App ends. Sections 5 (including the license you granted), 8, 9, and 12 through 18 survive termination.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a claim, you agree to first contact us at ops@scwr.org and try to resolve the dispute informally for at least 30 days. Any dispute that is not resolved will be heard exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

17. App Store Terms

If you downloaded the App from the Apple App Store or Google Play Store, these Terms are between you and LAIT911, not Apple or Google. Apple and Google are not responsible for the App or its content and have no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to the iOS App. Your use of the App must also comply with the applicable app store terms.

18. General

These Terms, together with our Privacy Policy, are the entire agreement between you and LAIT911 about the App. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a reorganization, merger, or transfer of the App.

19. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms in the App and on our website and update the "Last Updated" date. For material changes, we will provide reasonable advance notice in the App or by email. Your continued use of the App after changes take effect means you accept the updated Terms. Changes to the license in Section 5 apply only to User Content submitted after the change takes effect.
